  • Roe v. Wade Overturned

    On June 24, the U.S. Supreme Court upheld Mississippi’s restrictions on abortion, a ruling that may lead some states to enact severe abortion restrictions. Many employers will revise their employee health care benefits.

  • PCOR Fees due to IRS by July 31

    This is a reminder to employers sponsoring self-funded medical plans, MERPs, PFAs, and HRA plans to pay your annual PCOR Fee to the IRS by July 31, 2022.

  • San Francisco Employer Health Plan Contribution Reporting

    The following alert applies ONLY to employers with employees in San Francisco, CA.

    The San Francisco Health Care Security Ordinance (HCSO) requires covered employers to spend a certain dollar amount on health care (i.e. medical, dental, vision, prescription drug) for covered employees. The minimum health care expenditure for each covered employee is determined quarterly by multiplying the employee’s total number of payable hours in the quarter by the applicable health care expenditure rate.

  • Massachusetts COVID-19 Emergency Paid Sick Leave to End March 15, 2022

    On March 1, 2022, the state announced that the Massachusetts COVID-19 Emergency Paid Sick Leave program, which was originally set to expire on April 1, 2022, will now expire on March 15, 2022.

    Employers in Massachusetts must continue to offer COVID-19 paid sick leave to eligible employees through March 15th.

  • Compliance Alert: ACA Reporting Update

    2022 1095-C Delivery Extension

    Due date to deliver forms to employees: The IRS has announced a semi-permanent automatic extension for employers and insurers to deliver 2021 forms 1095-C and 1095-B to employees. The deadline for Applicable Large Employers (ALE’s) to deliver 2021 1095-C forms to employees has been extended by 30 days from January 31, 2022 to March 2, 2022.

  • Group Health Plans, Insurers Must Cover At-Home COVID-19 Tests

    The Departments of Labor, Health and Human Services (HHS), and the Treasury (collectively, the Departments) issued Frequently Asked Questions (FAQs) Monday that generally require group health plans and insurers to cover the costs of at-home over-the-counter COVID-19 tests (OTC COVID-19 Tests) approved by the U.S. Food and Drug Administration (FDA) and purchased on or after January 15, 2022.

  • Preparing for 2022 Illinois Enacts a New Employee Notice Requirement

    This alert applies only to employers with employees working in Illinois.

    The state of Illinois enacted a “Consumer Coverage Disclosure Act” which creates a requirement for Illinois employers (that is, any employer offering health coverage to an employee who works in Illinois) to provide a notice to employees that compares the employer offered plan to a list of Illinois essential health benefits.
